# Tintell – Record Gift Videos Privacy Policy

## Overview
Tintell – Record Gift Videos “the App” provides gift order identification and video message recording capabilities “the Service” to merchants who use Shopify to power their stores. This Privacy Policy describes how personal information is collected, used, and shared when you install or use the App in connection with your Shopify-supported store.
## Personal Information the App Collects
When you install the App, we are automatically able to access certain types of information from your Shopify account:
– **Shop Information:** Your shop domain, name, and basic store configuration
– **Orders:** Order IDs, order numbers, order values, order attributes (specifically “Send as a gift” attribute), order fulfillment status, and order creation timestamps
– **Customers:** Customer data associated with orders marked as gifts, including customer email addresses (for gift orders only)
– **Store Configuration:** Theme information and app block installation status
– **Merchant User Information:** Your name, email address, user ID, account owner status, and locale preferences
– **Fulfillments:** Fulfillment status to trigger video delivery notifications
Additionally, we collect the following types of personal information from you and/or your customers once you have installed the App:
**Information about you and others who may access the App on behalf of your store:**
– Name, email address, and billing information (collected through Shopify)
– App configuration settings and preferences you set within the App
– Optional custom logo uploads for app personalization
– Subscription plan selections and billing preferences
**Information about individuals who visit your store and interact with the gift features:**
– Gift checkbox selections made on the cart page (“Send as a gift: Yes” cart attribute)
– Video messages recorded on the thank you page, including:
– Customer’s name (as provided when recording)
– Text messages accompanying videos
– Video recording files
– Order number associated with the video
– IP addresses, web browser details, and time zone (collected through standard server logs)
– Session identifiers for maintaining video recording state
We collect personal information directly from the relevant individual, through your Shopify account, or using the following technologies:
**”Cookies”** are data files that are placed on your device or computer and often include an anonymous unique identifier. We use session cookies to maintain your logged-in state in the merchant admin. These cookies are essential for the App to function. **”Log files”** track actions occurring on the App, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
**”Local storage”** may be used temporarily in the video recording interface to store video data before upload. No tracking technologies are used to track customers across websites.
## How Do We Use Your Personal Information?
We use the personal information we collect from you and your customers in order to provide the Service and to operate the App. Specifically, we use this information to:
– **Provide Core Features:** Enable the gift checkbox on your cart page and conditional video recording prompt on the thank you page
– **Process Gift Orders:** Identify orders marked as gifts and trigger appropriate customer experiences
– **Store Video Messages:** Save and associate video messages with corresponding gift orders
– **Calculate Billing:** Track usage and calculate billing amounts based on gift orders processed
– **Enforce Quotas:** Monitor usage against your subscription plan limits and automatically disable features when quotas are exceeded
– **Manage Subscriptions:** Process plan changes, upgrades, cancellations, and submit usage charges to Shopify’s billing system
– **Communicate with you:** Send important notifications about your subscription, usage limits, and service updates
– **Optimize and improve the App:** Analyze aggregated usage patterns to enhance features and performance
– **Provide Analytics:** Show you dashboard analytics about gift order trends and video message usage (when analytics features are enabled)
– **Maintain Security:** Identify and fix technical issues, monitor for security threats, and maintain error logs
– **Ensure Compliance:** Respond to GDPR data requests, erasure requests, and handle shop data deletion
## Sharing Your Personal Information
We share your personal information with the following third parties to help us provide the Service:
**Shopify:** We share usage charge data with Shopify’s billing API to charge for your subscription based on your usage of the App.
**Video Processing Service (video.tintell.me):** Customer video recordings are transmitted to and stored by our video processing service. This service is operated by us and follows the same privacy practices. Videos are stored securely and associated with order numbers for retrieval. Order creation and fulfillment webhooks are sent to this service for video delivery management.
**Hosting Infrastructure:** Our App is hosted on secure cloud infrastructure providers in Germany (EU). These providers have access to server data but are bound by strict data processing agreements.
We do **not** sell, rent, or share your personal information with marketing companies, advertisers, data brokers, or any unaffiliated third parties for their own purposes.
Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
## Your Rights
**If you are a European resident,** you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.
Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above.
**Data Location:** Our primary servers are located in Germany within the European Economic Area (EEA), ensuring compliance with GDPR requirements for data storage and processing. Your information remains within the EU infrastructure.
**Customer Rights:** If you are a customer of a merchant using our App and would like to access, correct, or request deletion of your personal information (including video messages), please contact the merchant directly or email us at support@tintell.me with your order number.
## Data Retention
**Active Merchant Data:**
– Session data: Until session expiration (typically 24 hours)
– App settings: Until you uninstall the App or request deletion
– Billing records: Retained for 7 years for accounting and tax compliance purposes
**Order and Video Data:**
– Order references and gift designations: Retained as long as you use the App
– Video messages: Retained until you request deletion or uninstall the App
– Webhook processing logs: Retained for 90 days for duplicate prevention
**After App Uninstallation:**
We will delete most merchant data within 30 days of uninstallation, unless and until you ask us to delete this information earlier. Billing records are retained for legal and accounting requirements (7 years). Video messages may be retained unless you specifically request deletion.
## Changes
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. When we make changes, we will update the “Effective Date” at the top of this policy and display a notice in the App admin interface. For material changes, we may send an email notification to your registered email address. Your continued use of the App after changes take effect constitutes acceptance of the updated policy.
